Estate planning probate is a long and lengthy process that can happen when you have inadequate estate planning and you never filed a will.  Estate planning probate can easily be avoided if you file the proper estate planning forms and get it done right.The process can take months or even years and the people left behind cannot benefit from the assets you leave behind. Is this something you really want your family and loved ones to endure when you’re gone?

Estate planning probate is not anything that you would want to wish upon anyone let alone your family.  Your family will essentially have to go through a process to decide where your assets get disbursed to.  Sometimes this can end up being disbursed to the government.  Do you want anyone one else deciding where your assets will go?  Do you want your family to go through the torment of not knowing throughout this painful process?

You have worked all your life to amass certain assets.  Most of those assets are consumed in some way by those close to you already but there are others that really require estate planning.  Do your family a favor, go through some proper estate planning and help alleviate this burden of estate planning probate.

When you die, you will hopefully have drafted a last will and testament and appointed a guardian or executor to oversee.  The executor will then file this with the appropriate courts and then the will becomes judged as valid or not, and will hear any objections.  The court then assumes the responsibilities of paying creditors or debtors and will then distribute the leftover property or assets in the manner it sees fit.

If you don’t have a will, then the state becomes involved and will distribute your assets to your survivors and will then determine what will happen to any minor children that may be involved.  The major difference between dying with or without a will is that the courts will determine what happens if you don’t have a will and if you do have a will the courts will follow your desires and requests as set forth in your will.

If your will goes into probate however, the court will appoint attorneys to oversee your assets and the money used to pay them will come from the proceeds of your estate and this takes money away from your spouse and or children.  This is not something that most people would want to see happen, but can’t control once they are gone.  This is why estate planning and wills are so very important. 

You can only determine what happens while you have a voice, once you are gone the decisions can wind up in the wrong hands and your loved ones can be left out in the cold.  This is no place for the loved ones held closest to you to be.  Make sure that they are taken care of in the same fashion that they have taken care of you.
